National Symposium “Problems of Legal Sciences”

           The theme of this year’s symposium “Problems of Legal Sciences”, organized by the Sociology and Law Collective of the “Gheorghe Zane” Institute of Economic and Social Research, Romanian Academy – Iași Branch, within the XXXIX edition of the Iași Academic Days, is represented by specific aspects of negotiation in law.

            For more than a decade, the practice of negotiation has also been included in the Romanian criminal procedure, in the form of a plea agreement. Even if this special procedure is not specific to the continental European legal system, its application has consistently proven its benefits, both for the participants in the criminal process and for society in general. However, there are a number of controversial aspects of the idea of ​​negotiated justice, both in terms of its implementation and its theoretical justification – especially in terms of compliance with the classical principles of criminal procedure and, in general, of the administration of criminal justice.

           The acceptance of a plea bargain is particularly questionable in international law, because, in the case of the trial of particularly serious crimes, considerations of judicial efficiency should not take priority over those of a moral nature. The papers presented at the symposium can contribute to creating an ideological space conducive to the debate on such issues.

The topics of the presentations will fall within specific areas of international law, criminal procedural law and the philosophy of law.
